The Home Study

Preparing for a home study investigation is perhaps the most stressful part of the legal adoption procedure.  All states now require a home study, conducted by a licensed social worker, to prove that the adoptive parents will provide the right environment for a child.  They will review your financial stability, the health of your marriage, your lifestyle and career obligations, mental/physical health, and criminal history.  In addition, the social worker will aim to prepare the family for parenting an adopted child. 

Legal Adoption – the Court Process

Whether your adoption is handled by an agency or privately, it must first be approved by the Colorado state court.  This starts with the filing of an adoption petition, and requires an appearance before the court by all parties to the adoption.  In most cases, this includes the adoptive parents, the biological parents, an agency representative (if applicable), and a legal representative for the child. 

At the hearing, the Colorado court will determine whether the adoption is in the best interest of the child, and will order a final decree that formerly recognizes the new parent-child relationship.  It will also be the time at which the child’s name is legally changed.
