Colorado Springs Child Custody Attorney Discusses the Parenting Time Enforcement Act

According to Colorado Springs child custody attorneys, Colorado parents should pay close attention to the revised Colorado laws concerning parenting time in child custody cases.  The new Parenting Time Enforcement Act was set forth to enforce the state’s recognition that in most cases, having quality time with both parents is in the best interests of the child.  To this end, the state encourages children of divorced parents to spend a significant amount of time with the parent the non-custodial parent.

Colorado has instituted some state programs to ensure that the non-custodial parent retains the right to see their child, based on the belief that it is in the child’s best interest to remain in contact with both of their parents.  Based on this statute, Colorado judges are expected to grant significant visitation time to the other parent, and will work together to create a custody schedule that allows both parents the right to be involved in raising their children. 

Accordingly, the standard for all Colorado custody decisions is that nothing will be decided that doesn’t benefit the children.  This means the judge will consider the wishes of the child and the parents, as well as the child’s adjustment to home, school and the community where they live. Additional considerations include the interaction between the child and other family members; the physical and mental health of all parties involved in their upbringing, and the ability of all parties to encourage affection, love, and contact between the child and the other parent.  Parents should consider these factors when making their parenting plan.
