How Do You Know if You Need an Adoption Attorney?

adoption_attorneyEven the best laid plans can go awry, especially when it comes to adopting a child.  In fact, almost anyone who has been through the process will probably have “war stories” to share.  After multiple disappointments and last-minute changes in their plans, some couples eventually give up.

What is the best way to improve your chances of a successful adoption?  Hire an adoption attorney right from the start.

A qualified adoption attorney can review the documents you get from an adoption agency, make you aware of potential risks, and ensure that your rights are protected throughout the adoption process.  If a conflict does arise, you will already have an attorney that can step in and represent you in court.  Colorado adoption lawyers are already familiar with federal and state adoption laws.  Many attorneys recommend a formal meeting between the birth parents and adoptive parents, just to address any potential problems before they arise.

Depending on whether your adoption will take place in Colorado, another state, or another country, different laws will apply.  It is important that your adoption paperwork is written to the appropriate legal terminology; otherwise it could prove to be invalid.  Even if the adoption agency tells you that you won’t need a lawyer, it is ill-advised to attempt a legal adoption without the advice of an adoption attorney.

Remember, surrendering a child to an adoption agency is a very emotional thing to do, and some birth mothers have unexpected issues with signing away their parental rights.  Working with an adoption attorney involved from the start can help the birth mother to understand the legal aspects of an adoption earlier on, and help her make a more informed decision.
