Many Family Law Lawyers Now Recommend Collaborative Law

family_law_lawyers_2As divorcing couples look for ways to minimize their legal fees and smooth their transition back to single life, many Colorado family law lawyers are recommending collaborative law.  If you’ve never heard of collaborative law, it is exactly what it sounds like it is; a way to work together toward a “win-win” solution in a family legal matter.  The process is used by family law lawyers who help their clients resolve conflict in a respectful way.

In order to practice collaborative law successfully, the parties agree that a primary objective is to keep the conflict out of the courtroom and in the hands of the parties concerned.  Collaborate law cases don’t completely lack formality, however; as they usually require that the parties and their attorneys sign an agreement.  This agreement outlines the parameters of their working relationship and the goal of a “win-win” resolution. They also specify that, if any motion or issue is contested, both attorneys must withdraw from their representation.

One reason why collaborative law is so widely used by family law lawyers in divorce cases is that the parties may need to maintain a relationship after their conflict is settled.  Another reason is that it is usually much less expensive and much faster than courtroom litigation.  As collaborative law gains traction within the legal community, family law lawyers are fine-tuning their negotiation skills and conflict resolution.  In addition to the attorneys and their clients, other professionals may also be used in collaborative law.  These include accountants, appraisers and custody evaluators and other professionals who are retained independently by the parties.
