Every state in the US has adopted some form
of stalking law including Colorado where it comes under the heading of
harassment. However, it is treated on a more serious level than
harassment and is in fact, a Class 5 felony with repeated attempts
increasing in severity in the eyes of the law.
One of the problems facing victims, is the
difficulty of determining where the line is drawn and since stalking
initially typically does not involve direct contact, the person being
stalked feels a bit unsure about seeking legal help. However, stalking
is extremely dangerous and can result in serious injury to either the
victim, or someone else in their life.
Stalking Law in Colorado
Colorado law lays down three different types of stalking and is extremely thorough in its description of what can constitute the crime of stalking. Different types of stalking basically differ in the amount of actual threat presented. However, for stalking to occur, it is not necessary that any threat is present. Merely an unacceptable intrusion of his or her private life in such a manner as to cause emotional distress is enough.
The state of Colorado recognizes that stalking usually occurs when the people are known to each other and the perpetrator feels that there is a "bond" between themselves and the victim despite nothing of the sort being present. He or she believes that with enough persistence, the victim will reciprocate the "relationship."
Another danger that is clearly recognized is that the stalker might feel that any other relationships that the victim has with a third party poses a threat to their desired relationship. The third party need not be human and can even be an animal. There is a tangible danger therefore of harm to any person connected with the victim whom the stalker perceives as having a relationship with.
Legal Recourse
The victim can contact the police who will assist them in ending the threat. In case the stalker already has a restraining order placed on them, the crime is much more serious.
